1. General conditions

The user (hereinafter referred as “User” or “customer”) must carefully read these Terms and Conditions (hereinafter referred to as “Terms”) before using the website www.piursa.com (hereinafter referred to as “website”). By accessing and using the website, the User agrees to strictly comply with the provisions of these Terms, as well as the Privacy Policy [link].

These Terms constitute a binding agreement between the User and the company Catarina Branco Moreira (hereinafter referred to as “Piursa”) owning the online store.

The Piursa website is an online store that offers products for sale to the final consumer.

These Terms may be changed or adjusted at any time and without prior notice, except for payments already made.

 

2. Purchasing

2.1. Procedure

To make a purchase, the User should do the following:

  • Select the product, as well as the size and color (if applicable), and add it to the shopping cart (“add cart”). To choose the size, you can consult our "size chart".
  • If you wish to process your order, you must check your shopping cart and checkout.
  • To complete the shipping details, you must enter your contact details, as well as the address and shipping method details.
  • To complete your order, you must select the payment method and enter the corresponding payment data.
  • After confirming the order and authorizing the payment, you will receive an email confirming your order.

When making a purchase you are accepting the general purchase conditions, as well as all the conditions on the website, including our Privacy Policy [link].

2.2. Cancellation of purchase and product availability

Piursa reserves the right to refuse to process orders or to cancel an order in one or more of the following situations, in particular:

  • error or lack of information in the shipping data;
  • insufficient stock of the ordered product(s);
  • the order is detected as susceptible to fraud or when there is any suspicion of undue behavior;
  • the payment transfer occurs after the acceptable period;
  • if the payment is not made by an end consumer.

If the product ordered is unavailable, Piursa informs the buyer about this unavailability within 30 days after receiving the order. If payment has already been made, the corresponding refund will be made.

 

3.Payment

3.1. Payment methods

The payment methods available are: Paypal and Visa.

Piursa does not accept any payment method other than those presented. If you use an alternative method, Piursa will not be responsible for any loss or damage.


3.2. Payment processing

Payment data will only be used by Piursa to proceed with the purchase, refunds or other related items (such as returns, communication, support, order security, fraud verification).

Piursa is concerned with the safety of its buyers and their orders. Payment information will be encrypted using encryption software. Although Piursa applies its best efforts in securing its payments, it cannot be held responsible for any damage resulting from the use of electronic means by third parties.

 

4.Prices

Prices shown include VAT and are quoted in euros. Shipping fees are applied to each order.

The total price at the end of the checkout includes VAT and the corresponding shipping costs.

Piursa reserves the right to change prices without prior notice. The prices displayed at the time of purchase are the prices applied to that purchase.

If there is an error in the information on prices, Piursa reserves the right to cancel your order (and proceed to a refund, if applicable).

 

5. Promotions and promotional codes

When used according to the established rules, a promotion code enables the User to enjoy a promotion/discount related to the purchase of a specific product or for a set of products, during the period indicated/associated with the promotional code/campaign.

Promotional codes can only be used for online purchases made on this website. The sale, exchange or donation of a promotional code is not permitted. The customer with the promotional code cannot upload or make available a promotional code on any website or other public form of offer, donation, sale or exchange. The use of promotional codes for commercial purposes is not permitted.

Without prejudice to any other rights, Piursa reserves the right to immediately invalidate the promotional code in various situations, such as: suspected usurpation by third parties; connection with another brand, company or name; used in an illegal, abusive or disrespectful manner.

The offers on the website are valid only for the moment they are displayed on the website, unless stated otherwise.

 

6. Product quality and availability

The characteristics of the products are described on each product page.

The image and colors of the products presented may not fully correspond to reality as a result of using different browsers or screens.

The satisfaction of all orders is subject to availability. Piursa ensures as far as possible that all items offered for sale are in stock. However, we reserve the right not to accept or cancel orders for which there is no stock. The customer will be informed accordingly.

 

7. Selling availability by countries

We sell our products to the following countries:

Andorra, Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Romania, Slovakia, Slovenia, Spain, Sweden, United Kingdom, Aland Islands, Albania, Belarus, Bosnia and Herzegovina, Faroe Islands, Guernsey, Holy See (Vatican City), Iceland, Jersey, Kosovo, Macedonia, Republic of Moldova, Montenegro, Norway, Spain (Ceuta, Melilla), Switzerland, Ukraine.

 

8. Shipping and delivery

8.1. Delivery method

Piursa delivers the products on working days. Delivery can only be made if the shipping address is valid and located in one of the supported countries (see section 7.).

Our delivery services do not include the possibility of scheduling, so delivery will be made without prior notice.

A delivery is considered to be made with the signature of the delivery receipt at the defined address.

Upon delivery, the customer must inspect the packaging for possible damage. If the customer finds that the products are damaged, he/she must not accept the order and must return it. Piursa will proceed with the corresponding refund.

Any claim for non-receipt of an order must be made within a maximum period of 14 days from the date of placing the order. After this period, Piursa will not be responsible for its loss.

8.2. Delivery times

The following delivery times are defined:

  • Mainland Portugal - up to 3 working days;
  • Other European countries - up to 5 working days.

Piursa delivers on time to the extent commercially reasonable. Delivery times may vary during periods of promotions, sales, Christmas and stock out.

8.3. Shipping Fees

Shipping charges are applied per order. The exact price of each shipment depends on the country of delivery.

If the customer places an order whose value exceeds the minimum order value defined for his country or campaign, shipping will be done free of charge.

 

9. Exchanges or returns

9.1. Cancellation

The customer can cancel the order, as long as it has not been sent.

If you want to cancel, please send an email to infogeral@piursa.com with the following information:

  • full name;
  • email;
  • phone number;
  • address;
  • invoice number and date;
  • reference and article size;
  • add “Cancellation” in Subject.

9.2. Return or exchange

If for any reason the client is not satisfied with the products ordered, the customer has the right to return or exchange the products within 14 days of receiving the order, provided that:

  • the products have not been used or washed;
  • the product maintains its original characteristics;
  • the product is complete.

It is not possible to return or exchange adulterated items.

  • add "Return" in Subject.

9.3. Defective items

In case there is a defect in our products, the customer has 3 days to report the failure and send a photo to infogeral@piursa.com, together with the information listed above in case of return or exchange.

9.4. Return expenses

If the return is justified by the existence of a defect or non-conformity, Piursa will bear the costs of shipping and return, proceeding with its refund. If the return is justified for other reasons, Piursa will not refund the shipping costs.

 

10. Responsibility

Piursa is only responsible for the damages suffered by the client when such damages result from violations attributable to the contractual obligations towards our clients, or when so resulting from the applicable law.

Piursa's liability will be limited to damage to products sold, reasonable costs incurred by the customer, that is, the maximum refund of damages (the price of the products).

Piursa cannot be held responsible for damages suffered by third parties in the use of any of our products or by the customer as a result of improper use.

 

11. Applicable law and litigation

These Terms are drafted and interpreted in accordance with the Portuguese law.

 13. Changes to the Terms

These Terms can be changed at any time. The customer is subject to the Terms in force at the time of the order, unless stated otherwise by law.

 

14. Content

All content on the site is protected by Copyright and Related Rights, and Industrial Property Rights, under Portuguese and European Union laws, international conventions and other laws, and cannot be used outside the conditions allowed on this site and without consent of Piursa.

The intellectual property rights of all contents of Piursa, which are not externally supplied and as such duly identified, belong to Piursa, including information, tools, graphic design of the pages, as well as all its components and all the figures.

The content on the website may not be copied, altered or distributed unless expressly authorized by Piursa.

All texts, images, illustrations, photographs, advertising, brands and other elements of the website content are protected by law, and any copy, reproduction, disclosure or transmission, use, modification, sale, publication, distribution or any other use is expressly prohibited, total or partial, commercial or non-commercial, whatever the means used except with the express authorization of Piursa.

The use of the website for illegal purposes or any other that may be considered harmful to Piursa is prohibited.

Piursa rejects any responsibility for the usurpation and misuse of the elements mentioned above. An exception to this prohibition is the free use authorized by law, namely the right to quote, as long as its origin is clearly identified.

Piursa reserves the right to take legal action against the authors of any copy, reproduction or other unauthorized use.

 

15. Force majeure

Neither Party shall be considered in breach with its obligations if such failure was caused or resulted from a force majeure event.

A force majeure event is an event that prevents either party from fulfilling its obligations, is beyond its control and cannot be avoided by a diligent contractor.

The offending party shall immediately notify the offending party of the occurrence of the force majeure event.

The offending party will take the necessary measures to limit or restrict adverse effects.
